EPL is a legal requirement in accordance with Section 23A of the National Environmental Act No: 47 of 1980 and National Environmental Amendment Acts No: 56 of 1988 and No: 53 of 2000 for prescribed activities.
Prescribed activities are published through the Gazette Notification No.1533/16 dated 25.01.2008.
If as a result of the operation of a prescribed activity there is
- discharge of effluents
- deposition of wastes
- emission of smoke/gases/fumes/vapour
- emission of excessive noise/vibration into the environment,
then it is a legal requirement that such an industry/activity should obtain an EPL
